A pre-foreclosure notice, summons and complaint, court order and auction notice mean different things. Keep the envelope and note when and how each document arrived. Have a lawyer identify the stage and applicable deadlines. New York residential foreclosure generally proceeds through court.

A settlement conference can explore ways to resolve the case. Attending a conference does not replace answering the summons and complaint. Bring income and benefits records, expenses, mortgage and tax statements, rental-income records and prior workout correspondence. Attend even if your file is incomplete.

Give your attorney the actual sale notice, case index number, court papers and servicer communications. A phone call, pending application, complaint or appointment is not a confirmed postponement. Ask the attorney what relief may be available and get reliable confirmation of any change to the sale date.

If tenants live in the property, tell your lawyer. Tenant notices, lease rights and owner responsibilities require separate review. Do not promise vacancy or ask anyone to leave based only on a foreclosure notice.
